Rahul Gandhi Gets Relief from Supreme Court in ‘Modi Surname’ Case

In a major relief for Congress leader Rahul Gandhi, the Supreme Court on Friday stayed his conviction in the 2019 criminal defamation case against him over his ‘Modi surname’ remark. The order will allow him to return to parliament and contest national elections due next year.

The case dates back to 2019, when Rahul Gandhi made a speech in Wayanad, Kerala, in which he said that all thieves have the surname Modi. This remark was challenged by BJP leader Purnesh Modi, who filed a criminal defamation case against Rahul Gandhi.

In March 2023, a Surat court convicted Rahul Gandhi and sentenced him to two years in jail. Rahul Gandhi appealed the conviction to the Gujarat High Court, but the court upheld the verdict. Gandhi then filed a special leave petition in the Supreme Court.

On Friday, a bench of Justices BR Gavai, PS Narasimha, and Sanjay Kumar stayed Rahul Gandhi’s conviction and ordered that the matter be heard by a larger bench. The court said that the trial court did not give reason to justify the maximum sentence of two years to Gandhi, which resulted in his disqualification as MP.

The court also said that the remarks made by Gandhi were not in good taste, but that he should not be punished for them. “A person in public life is expected to exercise caution while making public speeches,” the court said. “He (Rahul Gandhi) ought to have been more careful.”
